Notice in accordance with section 265 of the Ngāi Tahu Claims Settlement Act 1998

Take notice that:

  1. The nohoanga entitlement marked “D” on Section 1 SO 423972 (Junction of Ōreti River and Irthing Stream) is terminated in reliance on section 265(1)(a) on the basis that the Crown has alienated the entitlement land. The Crown undertakes to grant a replacement nohoanga entitlement in consultation with Te Rūnanga o Ngāi Tahu.
  2. The nohoanga entitlement marked “A” on SO 19987 (Lake Pukaki) is terminated in reliance on section 265(1)(b) on the basis that the entitlement land is permanently detrimentally affected. The Crown grants a replacement entitlement under section 265(2) in respect of approximately 1.1486 hectares of land at Area A over Section 2 SO 497878 as shown on SO 529507. It is noted that Te Rūnanga o Ngāi Tahu has, in consultation with Te Rūnanga o Arowhenua Society Incorporated, Te Rūnanga o Waihao Incorporated, and Te Rūnanga o Moeraki Incorporated, confirmed by letter dated 29 August 2018 the agreement of Te Rūnanga o Ngāi Tahu to the termination and grant of a replacement.
  3. The nohoanga entitlement marked “A” on SO 7348 (Kōwhai Rivermouth) is terminated in reliance on section 265(1)(b) on the basis that the entitlement land is permanently detrimentally affected. The Crown undertakes to grant a replacement nohoanga entitlement in consultation with Te Rūnanga o Ngāi Tahu.

Notice in accordance with sections 256(6) and 256(9) of the Ngāi Tahu Claims Settlement Act 1998

Take notice that:

  1. the following nohoanga entitlements are hereby each renewed for a further term of ten years from the date set out in the tables below (initial further term); and
  2. at the expiry of the initial further term or any subsequent further term, each nohoanga entitlement is renewed for a further term of ten years (subsequent further term) subject to clauses 3 and 4 below; but
  3. a nohoanga entitlement is not renewed for a subsequent further term if either of the following is true:
    1. that entitlement has been terminated pursuant to section 265 of the Ngāi Tahu Claims Settlement Act 1998;
    2. Te Rūnanga o Ngāi Tahu gives notice to the Commissioner of Crown Lands in writing no later than 30 days prior to the expiry of the current further term that it does not wish for the entitlement to be automatically renewed; or
    3. The Commissioner of Crown Lands gives notice to Te Rūnanga o Ngāi Tahu in writing no later than 60 days prior to the expiry of the current further term that the Commissioner does not wish for the entitlement to be automatically renewed; and
  4. For the avoidance of doubt, notice under clauses 3b or 3c above does not constitute the termination of any nohoanga entitlement or any entitlement to a renewal of that entitlement under section 256(6) of the Ngāi Tahu Claims Settlement Act 1998, and that in the event of such notice being provided the Commissioner and Te Rūnanga o Ngāi Tahu will discuss the “manual” renewal of the nohoanga entitlement under section 256(6) of the Ngāi Tahu Claims Settlement Act 1998.
  5. If a nohoanga entitlement is granted in respect of land held under the Land Act 1948 in accordance with section 265(2) or section 265(6) of the Ngāi Tahu Claims Settlement Act 1998 as a replacement for a nohoanga entitlement referred to in this gazette notice, then the initial term of ten years is deemed to be the initial further term for the purposes of clauses 1 and 2 above, with the effect that the replacement entitlement is renewed in the same manner as the entitlements set out in the table below.
