Pursuant to the Public Works Act 1981, and a delegation from the Minister for Land Information, Nina Weir, Land Information New Zealand:

  1. Pursuant to sections 20 and 28, declares that an agreement to that effect having been entered into, the land described in the First Schedule to this notice is hereby acquired for a reservoir and shall vest in the Hauraki District Council.
  2. Pursuant to sections 20 and 28, declares that an agreement to that effect having been entered into, the easement in gross described in the Second Schedule to this notice is acquired upon the terms and conditions set out in the Third Schedule to this notice and shall vest in the Hauraki District Council.
  3. Pursuant to sections 20 and 28 of the Public Works Act 1981, declares that an agreement to that effect having been entered into, the easement in gross described in the Fourth Schedule to this notice is acquired upon the terms and conditions set out in the Fifth Schedule to this notice and shall vest in the Hauraki District Council.

Second Schedule

Easement Acquired

An easement in gross for the right to convey water over the land marked A on SO Plan 561349 (part RTSA263/37).

Third Schedule

Easement Rights and Powers for the Right to Convey Water

The easement in gross for the right to convey water shall contain the rights and powers implied in such easements by Schedule Five of the Land Transfer Regulations 2018.

Fourth Schedule

Easement Acquired

An easement in gross for a right of way over that area marked A on SO Plan 561349 (part RTSA263/37).

Fifth Schedule

Easement Rights and Powers for a Right of Way Easement in Gross

The Easement in gross for a right of way shall contain the rights and powers implied in such easements by Schedule Five of the Land Transfer Regulations 2018.
