I, Caroline McElnay, Director of Public Health, Ministry of Health, acting under delegation from the Minister of Health, make the following directions under the Burial and Cremation Act 1964 (“Act”):

1. Under section 41(1) of the Act, the burial ground, being the land known as the Waitara Historic Cemetery Waitara, being the land described in the Schedule to this notice (“burial ground”), shall be closed subject to the exception and qualifications set out in paragraph 2 below, and burials there shall be discontinued from and including 14 October 2022.
2. This closing order shall be subject to the following exception and qualification:

1. under section 44 of the Act, the control and management of the burial ground is vested in the New Plymouth District Council as from 14 October 2022.
