Notification of Proposed Maritime Rules

In accordance with sections 446(a) and (b) of the Maritime Transport Act 1994, Maritime New Zealand, on behalf of the Minister of Transport, gives notice of the Minister’s intention to make the following new Maritime Rules:

Part 404: Design, Construction, and Equipment – New Zealand Cape Town Vessels and Foreign Cape Town Vessels

The proposed Part 404 Maritime Rules implement New Zealand’s obligations under the Cape Town Agreement 2012. The proposed Rules also contain:

  • consequential amendments to existing rules in Parts 19, 21, 23, 25, 40D, 42B, 43, 45, and 46, as set out in Schedule 1 of the proposed Part 404
  • amendments to enable the making of transport instruments for the Director to specify standards in relation to proposed rules 404.44, 404.130, 404.131, 404.132, 404.181, 404.190, and 404.210, and for equivalents in proposed rule 404.15.

Comments are invited on the above proposed rules developed under the Maritime Transport Act 1994.

In addition, the Director of Maritime New Zealand is proposing to make transport instruments under the proposed new enabling provisions described above. These proposed transport instruments, with the exception of equivalents which will be developed as and when required, are included in the consultation package in order for the Director to consult on them pursuant to section 452C of the Maritime Transport Act 1994.

Consultation will commence on 16 September 2022.

Submissions must be made online or by email or post by the end of the day, 28 October 2022.
