Hazardous Substances (Safety Data Sheets) Notice 2017 Amendment 2022

This amendment to the Hazardous Substances (Safety Data Sheets) Notice 2017 is issued by the Environmental Protection Authority (“Authority”) in accordance with section 76C of the Hazardous Substances and New Organisms Act 1996 (“Act”). The Authority considers this amendment to be a correction of a technical error. The Authority now approves it for publication in the New Zealand Gazette.

Objective of Amendment

This amendment corrects a technical error in the Hazardous Substances (Safety Data Sheets) Notice 2017 (New Zealand Gazette, 3 November 2017, Notice No. 2017-au5637). Specifically, the requirement to provide CAS numbers of ingredients in a mixture has been moved from section 3(b)(ii) to section 3(b)(i) in Part A of the Schedule. This amendment reflects the original intent of this provision which is that CAS numbers are not required for ingredients in a mixture where a generic name is permitted.

Notice

1. Title

This is the Hazardous Substances (Safety Data Sheets) Notice 2017 Amendment 2022.

2. Commencement

This amendment is effective as at 30 September 2022.

3. Principal Notice

This is an amendment to the Hazardous Substances (Safety Data Sheets) Notice 2017 (New Zealand Gazette, 3 November 2017, Notice No. 2017-au5637).

4. Amendments

In Part A of the Schedule, under the heading “Section 3: Composition/information on ingredients”:

  1. In (b)(i) after “the chemical identity” insert “, including the CAS number,”; and
  2. in (b)(ii) delete the text “the CAS number of the ingredient; and”.
