Notice of Appointment of Receiver and Manager

Pursuant to Section 8(1A) of the Receiverships Act 1993

I, Duncan Varnham Fea, Chartered Accountant and Licensed Insolvency Practitioner (Registration Number IP101), hereby give notice that on 11 April 2022, Bank of New Zealand appointed me as receiver and manager in respect of specific property of the above-named company under the powers contained in:

1. the general security agreement dated 31 March 2014 granted by the company in relation to all of the company’s present and after-acquired property and all personal property in which the company has rights, whether now or in the future; and
2. Mortgage Instrument 9672257.2 containing memorandum of mortgage 2008/4261 granted by the company in favour of the Bank over the company’s land at Walker Road, Otago (comprising Record of Title 236318 (Otago Land Registry) and Record of Title 236321 (Otago Land Registry)).

I have been appointed receiver and manager in respect of:

1. the company’s land at Walker Road, Otago (comprising Record of Title 236318 (Otago Land Registry) and Record of Title 236321 (Otago Land Registry)) (“Land”); and
2. the income from the Land.

All receivers are required by law to be Licensed Insolvency Practitioners. More information about the regulation of insolvency practitioners is available from the Registrar of the Companies Office.
