Notice of First Meeting of Creditors

Pursuant to Sections 239AL, 239AN and 239AO(1)(a) of the Companies Act 1993 (“Act”)

We, Rees Logan and Andrew McKay, Licensed Insolvency Practitioners of BDO Auckland (Registration Numbers IP34 and IP40 respectively), were appointed joint and several administrators of the companies on 9 October 2022.

Notice to Creditors

All creditors should forward details of any claim they may have against the companies, including details of any claims made against the assets of the companies in the prescribed claim form, to the administrators at the address detailed below. Please contact Dalwyn Whisken at the administrators’ office by email bri.akl@bdo.co.nz for a copy of the claim form.

Notice of Joint First Meeting of Creditors

Notice is now given that a meeting of the creditors of the companies will be jointly held (in accordance with section 239AL of the Act) at the following location on Wednesday 19 October 2022 at 1.00pm at the companies’ premises at 697C Wairere Drive, Chartwell, Hamilton.

If any creditor wishes to object to the joint meeting they must submit their objections to the administrators to the address detailed below to be received no later than 1.00pm on Monday 17 October 2022. Unless any creditor objects in accordance with this notice, all creditors will be taken to have agreed to the joint meeting. Notwithstanding that the first creditors’ meeting may be a joint meeting, voting for the motions will be conducted separately for each of the companies.

The business to be dealt with at the meeting is for creditors of each of the companies to decide:

1. whether to appoint a creditors’ committee and, if so, its members; and
2. whether to replace Rees Logan and Andrew McKay as administrators.
