Notice Pursuant to Section 114 of the Land Transfer Act 2017

An application under section 114 of the Land Transfer Act 2017 has been received for the removal of an easement. The applicant claims the easement is extinguished by reason of the circumstances set out below.

If no objections have been received before 30 July 2021, the Register will be updated to record the easement as redundant.

Applicant: Thomas Matthew Willock Purcell, 20 Tukura Road, Inner Kaiti, Gisborne 4010

Circumstances: The right of way is extinguished because an event specified in Easement Certificate (EC) 87999 occurred and brought it to an end. Clause 3(a) of EC 87999 states that the right of way shall be appurtenant to the benefited land so long only as Walter Max Willis and Agnes Willis (or their executors or administrators) are the registered owners of the benefited land. The ownership of the benefited land was transferred on 4 December 1978 under Transfer 129212.2, which had the effect of the right of way no longer being in force.

Easement: A right of way over part Lot 2 DP 5318 coloured blue on DP 5318 in Record of Title (RT GS2B/194) owned by Thomas Matthew Willock Purcell for the benefit of Lot 1 DP 5318 in RT GS2B/195 owned by Alva Moira Langford and David Gibson Langford created by Easement Certificate 87999 registered on 29 April 1968.
