Notice Pursuant to Section 115 of the Land Transfer Act 2017

An application under section 115 of the Land Transfer Act 2017 has been received for the removal of an easement. The applicant claims the easement is extinguished by reason of the circumstances set out below.

If no objections have been received before 9 July 2021, the Register will be updated to record the easement as redundant.

Circumstances: The benefited land (Lots 1–13, 16–28, 101, 200–203 and 302 DP 544083) have been separated from the burdened land by subdivision on DP 544083 and the benefited land (Lots 610 and 611 DP 528695) have been separated from the burdened land by subdivision on DP 528695.

Easement: A right to convey water over part Lot 501 DP 544083 marked W on DP 544083 in Record of Title (RT) 923655 owned by Burberry Developments Limited for the benefit of Lots 1–13, 18–28, 201–203 and 302 DP 544083 in RT 923620–923632, 923635–923643 and 923648–923653 owned by Barfilon Investment Limited, Lot 16 DP 544083 in RT 923633 owned by Darryl Bill Suasua and Davida Marie Suasua, Lot 17 DP 544083 in RT 923634 owned by John Brendon Stanton and Kathryn Helen Stanton, Lot 200 DP 544083 in RT 923647 owned by Horizon Resources Limited and Lot 101 DP 544083, Lots 610 and 611 DP 528695 in RT 923656, 892878 and 892879 owned by Queenstown Lakes District Council created by Easement Certificate C878364.7 registered on 16 August 1995.
