Land Declared Road and Easements Acquired for the Functioning Indirectly of a Road—State Highway 35, Te Puia, Puketiti, Gisborne District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Sanket Palshikar, Land Information New Zealand, declares that:

  1. pursuant to section 20, and an agreement to that effect having been entered into, the land described in the First Schedule to this notice is declared road, pursuant to section 114 of the Act, and shall vest the Crown; and
  2. pursuant to sections 20 and 28, and an agreement to that effect having been entered into, the easement in gross described in the Second Schedule is acquired for the functioning indirectly of a road over the balance of the land in Record of Title GS2C/384 on the terms and conditions as provided in the Third Schedule to this notice and shall vest in the Crown

on the date of publication hereof in the New Zealand Gazette.

Rights and Powers

The easements shall contain the rights and powers implied into the right to drain water contained in the Fifth Schedule to the Land Transfer Regulations 2018, and for the avoidance of doubt, includes the right of the Crown to install, replace and/or upgrade drainage culverts.
