Extension of Reporting Time Limits Under the National Animal Identification and Tracing Act 2012

Pursuant to section 34(2)(a)(ii) of the National Animal Identification and Tracing and Tracing (NAIT) Act 2012, I, Stephen Stuart, acting under delegated authority as Chief Executive of National Animal Identification and Tracing Limited, which is the designated NAIT organisation, give notice of alternative time limits to those prescribed by regulations made under the NAIT Act 2012 for the provision of information by any person in charge of animals (PICA).

On behalf of the NAIT organisation, I am satisfied on reasonable grounds that non-compliance with the time limits prescribed by these regulations is justified due to the impact of COVID-19 alert level changes on farming operations and NAIT operations.

These alternative time limits take effect on the date of publication of this notice and expire fourteen calendar days after that date.

They are alternative time limits to those prescribed by the National Animal Identification and Tracing (Obligations and Exemptions) Regulations 2012.

  • Alternative time limit in Regulation 10(1) to extend the “48 hours” requirement to five business days: “A person registering under section 27(1) as a PICA or PICA delegate must do so within 48 hours after the end of the day on which the person becomes a PICA or PICA delegate”
  • Alternative time limit in Regulation 10(3) to extend the “48 hours” requirement to five business days: “A PICA making a declaration under section 31(1) (movement) must make it within 48 hours after the end of the day:
    1. on which the movement starts, in the case dealt with in section 31(2)(a);
    2. on which the movement ends, in the case dealt with in section 31(2)(b)”
  • Alternative time limit in Regulation 10(4) to extend the “48 hours” requirement to five business days: “A PICA making a declaration under section 32 [exit declarations] must make it—
    1. within 48 hours after the end of the day on which the animal is slaughtered, in the cases dealt with in Regulation 9(2);
    2. within 48 hours after the end of the day on which the PICA first knows that the animal has died, in the cases dealt with in Regulation 9(3):
    3. within 48 hours after the end of the day on which the PICA first knows that the animal is lost, in the cases dealt with in Regulation 9(4)”
  • Alternative time limit in Regulation 21(3)(c) to extend the “48 hours” requirement to five business days: the PICA must “provide [a declaration] to the NAIT organisation within 48 hours after the end of the day on which the animal movement ends”
