Exemption Under Clause 105 of the COVID-19 Public Health Response (Protection Framework) Order 2021

Pursuant to clause 105 of the COVID-19 Public Health Response (Protection Framework) Order 2021 (“Order”), the Director-General of Health may exempt a class of persons, businesses, services, or goods (or any person, business, service, or goods) from the application of any provision of the Order or from the requirement to comply with any provision of the Order.

Being satisfied that the exemption is necessary or desirable to promote the purposes of the COVID-19 Public Health Response Act 2020 or the purposes of the Order, and the extent of the exemption is not broader than is reasonably necessary, I grant an exemption for:

  • the crew on board the United States Coast Guard Cutter (USCGC) Polar Star.

The exemption is to clause 29 and clause 30 of the Order, for persons to produce a temporary exemption issued by the Ministry of Health to permit entry to a premise of a regulated business or service that requests a COVID-19 vaccination certificate (CVC).

Conditions

The exemption is subject to the following conditions:

  1. Persons must produce the temporary exemption when a CVC is requested to enter the premise of a regulated business or service;
  2. Persons must comply with all other requirements under the Order, such as physical distancing and face-covering requirements;
  3. The exemption will expire on 24 December 2021.
