Notice That Anti-dumping Duties on Preserved Peaches from Spain May Cease to Apply

Pursuant to section 13A(1)(c) of the Trade (Anti-dumping and Countervailing Duties) Act 1988 (“Act”), anti-dumping duties imposed on preserved peaches from Spain will cease to apply to those goods on 5 August 2021, unless at that date the goods are subject to review under section 17D of the Act.

Any interested party that might request that the chief executive of the Ministry of Business, Innovation and Employment start a full review before the cessation date referred to above should be aware that positive evidence justifying the need for a full review must be provided to the chief executive.

Positive evidence justifying the need for a full review would need to include reasons and evidence for believing that:

  • the continued imposition of the duty is necessary to offset dumping of preserved peaches from Spain; and
  • material or threatened material injury to the New Zealand industry producing preserved peaches would be likely to continue or recur if the duty expired.
