Insolvency Practitioners Regulation Act (Transitional Requirements) Notice 2021

Pursuant to section 22(1)(f) of the Insolvency Practitioners Regulation Act 2019, the Registrar of Companies gives the following notice.

1. Title and Commencement

(1) This notice is the Insolvency Practitioners Regulation Act (transitional requirements) Notice 2021.

(2) This notice comes into force on the day after its publication in the New Zealand Gazette.

2. Interpretation

In this notice, unless the context otherwise requires, any term or expression that is defined in the Insolvency Practitioners Regulation Act 2019 and used, but not defined, in this notice has the same meaning as in that Act.

3. Transitional Requirements

The transition period for the Insolvency Practitioners license ends on 31 August 2021. A person who is the liquidator of a company and who, on 1 September 2021, is not a licensed insolvency practitioner must resign on this date, and section 283 of the Companies Act 1993 (as amended by Part 1 of the Insolvency Practitioners Regulation (Amendments) Act 2019) applies accordingly.
