Pursuant to section 223(a) of the Telecommunications Act 2001 and Schedule 5 of the Commerce Act 1986, the Commerce Commission (“Commission”) gives notice that it is consulting on its proposal to incorporate material by reference into the Fibre Price-Quality Path Determination 2021, due to be published on 16 December 2021 (“PQ determination”).

The material the Commission proposes to incorporate by reference is:

• The “Notice of points of interconnection under section 231 of the Telecommunications Act 2001” issued by the Commission on 19 December 2019 (“section 231 notice”); and
• The “Interfaces Group MIB Internet Official Protocol Standard RFC 2863” issued by the ETF Interfaces MIB Working Group in June 2000 (“RFC 2863”).

Both documents are also available for inspection during the hours of 8.30am to 5.00pm, Monday to Friday, by appointment, at the Commerce Commission, Level 9, 44 The Terrace, Wellington.

The Commission proposes to incorporate this material by reference as it considers that the material deals with technical matters, and it is impractical to include it in the PQ determination.

Interested persons can comment on the proposed incorporation by reference by uploading a submission to the Commission’s portal by 5.00pm on Friday 10 December 2021. The portal is available online: https://comcom.govt.nz/file-upload-form-folder/file-upload-form.
