The Commerce Commission (“Commission”) gives public notice under section 170(5)(b) of the Telecommunications Act 2001 (“Act”) that it has determined and published the Fibre Information Disclosure Determination 2021 [2021] NZCC 24 (“Fibre ID determination”).

Summary of the Fibre ID Determination

The Fibre ID determination sets the information disclosure (“ID”) requirements applicable to persons supplying fibre fixed line access services (FFLAS) prescribed in regulations made under section 226 of the Act as being subject to ID regulation under the Act (“regulated providers”).

Under the Fibre ID determination, regulated providers must publicly disclose, and supply the Commission with, certain financial and non-financial information relating to their supply of FFLAS to enable interested persons to assess whether the purpose of Part 6 of the Act is being met.

Material Incorporated by Reference

Under section 223(b) of the Act and Schedule 5 of the Commerce Act 1986, the Commission gives notice that it has incorporated material by reference into the Fibre ID determination. The material incorporated by reference is:

  • International Standard on Assurance Engagements (New Zealand) 3000, Assurance Engagements Other than Audits or Reviews of Historical Financial Information, issued by the New Zealand Auditing and Assurance Standards Board of the External Reporting Board in July 2014, under section 12(b) of the Financial Reporting Act 2013 (ISAE (NZ) 3000); and
  • Standard on Assurance Engagements 3100 – Compliance Engagements, issued by the External Reporting Board in October 2014 and incorporating amendments up to August 2014 under section 24(1)(b) of the Financial Reporting Act 1993 (SAE 3100).
