Commerce Commission—Notification of Amendment to Transpower Individual Price-Quality Path Determination 2020 [2019] NZCC 19
Under section 52Q of the Commerce Act 1986 (“Act”), the Commerce Commission (“Commission”) gives notice that it has amended the Transpower Individual Price-Quality Path Determination 2020 [2019] NZCC 19 (“principal determination”).
The amendments are set out in the Transpower Individual Price-Quality Path Amendment Determination 2021 (No.1) [2021] NZCC 19.
The amendment determination amends the principal determination’s price path for Transpower New Zealand Limited in light of the Commission’s reconsideration of the price path to take account of the Electricity Authority’s decision on the Transmission Pricing Methodology guidelines.
The amendment determination also corrects drafting errors in the definitions of ‘actual transmission revenue’ and ‘other regulated income’ under clause 7 of the principal determination, to ensure the wash-up calculation under clause 9 of the principal determination operates correctly.
A more detailed description of the amendments is set out in our reasons paper, Reconsideration of Transpower’s individual price-quality path determination in response to the Electricity Authority decision on Transmission Pricing Methodology guidelines – changes to 2020-21 expenditure allowances for the costs of TPM development – Final decision, which can be viewed at https://comcom.govt.nz/regulated-industries/electricity-lines/electricity-transmission/transpowers-price-quality-path/setting-transpowers-price-quality-path-from-2020.
The amendment determination comes into effect on the date of this notice.
Copies of the amendment determination are available on the Commission’s website at the above link, and for inspection free of charge, or for purchase at a reasonable price, at the Commission’s premises (during ordinary office hours) at 44 The Terrace, Wellington.
Dated this 7th day of October 2021.
COMMERCE COMMISSION.
