Notice of Appointment of Liquidators and
Notice of Creditors to Claim

On 1 December 2020 at 10.10am, by special resolution of the shareholders, the above-named company was put into liquidation, pursuant to section 241(2)(a) of the Companies Act 1993 (“Act”), and David Thomas was appointed liquidator by consent. The court found that David Thomas’s appointment was invalid as it was outside the statutory timeframe prescribed by section 241AA of the Act.

On that basis, on 3 February 2021 at 4.45pm, the court appointed Rhys Cain and Rees Logan, Licensed Insolvency Practitioners, as joint and several liquidators of MIDWAY TRANSPRO LIMITED (“company”) by order of the High Court at Rotorua, pursuant to section 241(2)(c) of the Act. The applicant creditor was Z Energy Limited.

We fix 26 March 2021 as the day by which the creditors of the company are to make their claims and to establish any priority, under section 312 of the Act, or to be excluded from the benefit of any distribution made before their claims are made or, as the case may be, from objecting to any distribution.
