Exemption of Classes of Persons From Requirements of the COVID-19 Public Health Response (Alert Levels 3 and 2) Order 2020

Pursuant to clause 27 of the COVID-19 Public Health Response (Alert Levels 3 and 2) Order 2020 (“Order”), I, Dr Ashley Bloomfield, Director-General of Health, Ministry of Health, hereby declare that the following persons are exempted from clauses 8 and 23 of the Order:

  1. Persons employed or engaged by BOC Limited, Elgas Limited and Alexander Bulk Gases Limited who are directly involved in manufacturing, production and distribution of medical oxygen and related products to travel to and from work sites in Auckland and their place of residence outside Auckland.
  2. Persons employed or engaged by BOC Limited, Elgas Limited and Alexander Bulk Gases Limited for travel to and from medical facilities as is necessary to repair and maintain critical medical gas equipment.
  3. Persons employed or engaged by BOC Limited, Elgas Limited and Alexander Bulk Gases Limited to travel as required for urgent field support.

The persons subject to the exemptions in this notice are subject to the following conditions:

  1. Persons must travel as directly as reasonably possible to complete their work;
  2. The persons may only travel out of an alert level 3 area if their workplace has undertaken the following measures to mitigate the risk of COVID-19 spread:
    1. Record their movements, including the place of work travelled to, to support contact tracing.
    2. Ensure two metre distancing is maintained from other persons during work activity where practicable.
    3. Ensure appropriate public health and hygiene measures are taken.
    4. Where applicable, comply with the Health and Safety plan for the particular work activity.

The exemption will begin at 11.59pm on 20 August 2020 and cease at the expiry of the Order.
