Notice of Variation of a Scheduled International Air Service Licence and of an Open Aviation Market Licence

Pursuant to sections 87Q(4) and 87X(4) of the Civil Aviation Act 1990, section 41(1) of the State Sector Act 1988, and a delegation from the Secretary for Transport dated 12 February 2020, I, Thomas Hamilton Forster, Manager – Economic Regulation in the Ministry of Transport, hereby give notice that I have:

  • exercised the power conferred by section 87Q of the Civil Aviation Act 1990 to vary the terms of the Scheduled International Air Service Licence issued to Air Pacific Limited (trading as Fiji Airways), Air Vanuatu (Operations) Limited, Cathay Pacific Airways, China Airlines, Korean Air, Qantas Airways Limited, Qatar Airways Q.C.S.C. and Thai Airways International Public Company Limited respectively to incorporate a new provision that allows for the imposition of a temporary cap on passenger numbers carried by those airlines; and
  • exercised the power conferred by section 87X of the Civil Aviation Act 1990 to vary the terms of the Open Aviation Market Licence issued to Hawaiian Airlines and LAN Airlines S.A. respectively to incorporate a new provision that allows for the imposition of a temporary cap on passenger numbers carried by those airlines.

The effective date of these variations is 8 August 2020.
