Establishment of a Combined Board and Alternative Constitution for Te Kura Kaupapa Māori o Manurewa (4229) and Te Wharekura o Manurewa (3113)

  1. Pursuant to clauses 7 and 4 of Schedule 22 of the Education and Training Act 2020 (“Act”), I hereby establish a combined board and approve an alternative constitution for Te Kura Kaupapa Māori o Manurewa (4229) and Te Wharekura o Manurewa (3113).
  2. The combined board for Te Kura Kaupapa Māori o Manurewa and Te Wharekura o Manurewa (“board”) will be made up of the following members:
    1. three parent representatives for Te Kura Kaupapa Māori o Manurewa;
    2. three parent representatives for Te Wharekura o Manurewa;
    3. two Tumuaki (the Principals of the Kura and Wharekura);
    4. one student representative from Te Wharekura o Manurewa;
    5. two staff representatives – one nominated and elected by the staff of Te Kura Kaupapa Māori o Manurewa, and one nominated and elected by the staff of Te Wharekura o Manurewa;
    6. one Trustee appointed by Te Whānau o te Putahi Māori o Manurewa (the combined whānau committee of Te Kura Kaupapa Māori o Manurewa and Te Wharekura o Manurewa);
    7. up to two trustees co-opted by the Combined Board on the basis of particular experience, expertise, skill and/or leadership that in the opinion of the board will assist in advancing the kaupapa of Te Kura Kaupapa Māori o Manurewa and Te Wharekura o Manurewa.
  3. Notwithstanding clause 5 of Schedule 22 of the Act, the following provisions of the Act will apply to the board:
    • clause 1 of Schedule 22 (Parent representatives);
    • clause 2 of Schedule 22 (Staff and student representatives);
    • clause 3 of Schedule 23 (Elections of board members);
    • clause 8 of Schedule 23 (Term of office);
    • clause 12 of Schedule 23 (When casual vacancies arise); and
    • clause 13 of Schedule 23 (Filling casual vacancies of elected board members).

Parent Representatives

  1. The parent representatives will be elected in accordance with subclause 1(3) of Schedule 22 of the Act.
  2. Each candidate shall be nominated and elected by the parents of students attending the kura which the candidate is being nominated to represent, in respect of each school the combined board will administer. If whānau have tamariki at both kura, then they will receive two voting packs.
  3. The votes for whānau elected trustees are counted separately under each kura.
  4. The three highest polling candidates nominated in respect of each kura shall become a trustee, regardless of the votes cast for the other candidates.

Te Whānau o te Putahi Māori o Manurewa Representative

  1. Te Whānau o te Putahi Māori o Manurewa is the combined whānau committee of Te Kura Kaupapa Māori o Manurewa and Te Wharekura o Manurewa.
  2. Te Whānau o te Putahi Māori o Manurewa may appoint one eligible trustee, to represent Te Whānau o te Putahi Māori o Manurewa, for a term of office of up to one year.
  3. Te Whānau o te Putahi Māori o Manurewa may re-appoint an eligible trustee to represent Te Whānau o te Putahi Māori o Manurewa, for subsequent terms of office of up to one year.
  4. Te Whānau o te Putahi Māori o Manurewa may specify a shorter term of office for appointed trustees at their discretion.
  5. A casual vacancy for the Te Whānau o te Putahi Māori o Manurewa representative must be notified promptly by the board and such vacancies will be filled in the same manner as the vacating trustee was appointed for the residue of the term of the vacating trustee.
  6. Te Whānau o te Putahi Māori o Manurewa will notify the board each time a new Te Whānau o te Putahi Māori o Manurewa Chair is elected.

Co-opted Members

  1. The term of office for eligible co-opted trustees is no more than 1 year.
  2. Eligible trustees may be co-opted for further terms not exceeding 1 year.
  3. A board resolution co-opting a trustee may specify a shorter term of office.
  4. Casual vacancies for co-opted trustees must be notified promptly by the board and such vacancies will be filled in the same manner as the vacating trustee was co-opted for the residue of the term of the vacating trustee.

Transitional Arrangements

  1. For the purpose of subclause 3(9) of Schedule 23 of the Act, the first meeting of the combined board under this alternative constitution will be on 2 October 2020. The first trustees elected, appointed or co-opted under this constitution will take office on this date.
  2. All current trustees on the boards shall leave office at the end of the day before the day on which the new trustees take office.
  3. With the application of clauses 3 and 8 of Schedule 23 of the Act, the next elections for Parent and Staff representatives will take place during the dates gazetted for the 2022 triennial election period and triennially thereafter.
  4. In line with clause 2 of Schedule 22 and clause 3 of Schedule 23 of the Act, student elections will take place annually.

This notice shall take effect on from 2 October 2020.
