Amendment of Notice of Direction to Appoint a Limited Statutory Manager for the Richmond School (2665) Board of Trustees

Under section 78M(6) of the Education Act 1989, with delegated authority from the Minister of Education, I hereby amend the notice (as published in the New Zealand Gazette, 18 December 2019, Notice No. 2019-go5913) directing the Secretary for Education to appoint a limited statutory manager for the Richmond School Board of Trustees (“Board”), by vesting the following functions, powers and duties of the board in the limited statutory manager.

  1. The following functions, powers and duties of the board are to be vested in the limited statutory manager:
    1. All functions, powers and duties of the board as an employer (whether statutory or otherwise); and
    2. All functions, powers and duties of the board in curriculum management including teaching and assessment practice (whether statutory or otherwise); and
    3. All functions, powers and duties of the board in relation to property management (whether statutory or otherwise); and
    4. All functions, powers and duties of the board to establish policies and procedures (whether statutory or otherwise); and
    5. All functions, powers and duties of the board to manage communications (whether statutory or otherwise); and
    6. All functions, powers and duties of the board to manage financial operations (whether statutory or otherwise); and
    7. All functions, powers and duties of the board to manage health and safety (whether statutory or otherwise); and
    8. Any conditions attaching to the exercise of the powers by the board.
  2. The following conditions are placed on remaining board members, regarding functions, powers and duties of the board:
    1. A requirement that board members consult with the limited statutory manager before exercising any functions, powers or duties.
  3. The board will retain its primary duty of care as a person conducting a business or undertaking, under the Health and Safety at Work Act 2015, above and beyond all functions, powers and duties of this limited statutory manager.

This notice takes effect on the date of publication.
