Public Notice of Application for Approval of a Scheme of Variation

Pursuant to Section 36 of the Charitable Trusts Act 1957

In the High Court of New Zealand, Wellington Registry:

In the matter of Part 3 of the Charitable Trusts 1957, and in the matter of an application by The Parkinsons New Zealand Charitable Trust in relation to certain charitable trusts declared by the will of Hazel Bernice Ham, deceased, Femme Sole, late of Whangarei.

Take notice that on 15 March 2021 at 10.00am, or so soon thereafter as Counsel may be heard, the applicant will apply to the High Court at Wellington for an order approving a scheme to vary the terms of the charitable trust established by the will of the late Hazel Bernice Ham.

The purpose of the application is to update such trusts on the grounds that due to the dissolution of Parkinsonism Society of Northland Incorporated it is now impossible or impracticable or inexpedient to carry out the purposes for which the Trust was originally established. Further particulars of the application may be obtained from the office of Maude & Miller at the address for service shown below.

The proposed scheme and the Attorney-General’s report are also available for inspection free of charge at the High Court at Wellington.

Any person desiring to oppose the proposed scheme must give written notice of their intention to do so to:

  1. The Registrar of the High Court at Wellington;
  2. Maude & Miller at the address for service below; and
  3. The Attorney-General at the Crown Law Office, PO Box 2858, Wellington 6140

not less than seven clear days before the matter is due to be heard.
