Notice of Application to Approve a Scheme

The Young Men’s Christian Association of Christchurch Charitable Trust (“YMCA”) hereby gives notice under section 36 of the Charitable Trusts Act 1957 that it has applied to the High Court at Christchurch for the approval of a scheme varying THE BOYS’ GORDON HALL TRUST. The application will be heard at 10.00am on 10 August 2020, in Courtroom 12 at the Christchurch High Court.

The YMCA is applying to have the property of THE BOYS’ GORDON HALL TRUST pooled with the charitable trust funds of the YMCA but retained as a separate and distinct fund under the administration of the YMCA, and for the YMCA to be free to apply the income from the fund for its own charitable purposes. The application is brought on the basis that it is impossible, impracticable or inexpedient to administer THE BOYS’ GORDON HALL TRUST, as contemplated by the Codicil to the Will of the late Sir John Hall.

Any person who wishes to oppose the proposed scheme must give notice of their intention to do so no later than 7 days prior to the hearing. Such notice must be delivered to:

  1. The Registrar of the High Court at Christchurch – c/ Alec.Huisman@justice.govt.nz and christchurchhc@justice.govt.nz;
  2. Solicitors for the YMCA – Peter Eastgate and Matt Rhodes of Cavell Leitch, – Peter.Eastgate@cavell.co.nz and Matt.Rhodes@cavell.co.nz; and
