Pursuant to regulation 85(1) of the Gas (Safety and Measurement) Regulations 2010 (“Regulations”), I, Tony Hetherington, Head of High Hazards, Energy and Public Safety, WorkSafe New Zealand, give the following notice of exemption.

1. Short title and commencement

This notice is the Gas (Safety and Measurement) Regulations—Exemption for European Gas Appliances Notice 2020.

This exemption is to take effect on 11 February 2020.

2. Exemption

Gas appliances that are certified under the European Gas Appliances Regulation (EU GAR) to a standard identified in clause 4.1 of this notice are hereby exempt from the requirements of regulation 54(3) of the Regulations, provided that the certification was obtained before the appliance was sold or offered for sale in New Zealand and they—

  • are certified by a certification body identified in clause 3 of this notice; and
  • meet all of the relevant conditions in clause 5 of this notice; and
  • are not excluded under clause 6 of this notice.

3. Certification bodies

A body that is working within European Gas Appliances Regulation (EU GAR) – Regulation (EU) 2016/426 may certify gas appliances and specified fittings for the purposes of this notice.

4. Standards

4.1. The applicable EU GAR standards are as follows:

4.2. In this notice—

standard A means EN 30-1-1:2008+A3:2013 Domestic cooking appliances burning gas. Safety. General;

standard B means EN 203-1:2014/AC:2016 Gas heated catering equipment. General safety rules;

standard C means BS EN 15502-1:2012+A1:2015 Gas-fired heating boilers. General requirements and tests.

4.3. An appliance is deemed to have been certified to an applicable European (EN) standard specified in clause 4.1 if the appliance has been certified to a published national standard.

4.4. For the purposes of this clause, published national standard means a standard published by a national standardisation body that is a member of the Committee of European Standards (CEN) as being the national implementation of the relevant European (EN) standard.

5. Conditions

The following conditions apply to appliances exempt under this notice:

  1. each appliance must include instructions in English for its installation and use;
  2. an appliance incorporating electrical equipment with a low voltage external supply must be tested for gas safety compliance using a supply of 230 volts, 50 Hz (nominal);
  3. an LPG appliance, other than an appliance for use with non-refillable cartridges, must be certified to Category I3B/P 30 or I3B/P 28–30;
  4. a natural gas appliance must be certified to Category I2H.

6. Exclusions

This notice does not apply to:

  1. any gas appliance operating with a valve cartridge which is horizontally integrated into the chassis of the appliance also called flat portable gas stove;
  2. any portable space heater not intended for connection to a cylinder, and intended for connection to a valve cartridge which is horizontally integrated into the chassis of the appliance;
  3. any mobile or portable, unflued heater that is designed for indoor use and operates on liquefied petroleum gas (LPG) using an LPG gas cylinder that is self-contained within the heater, commonly known as a cabinet heater.

7. Expiry

Unless revoked or amended earlier, this notice expires on 31 March 2021.
