Pursuant to Regulation 87(1) of the Electricity (Safety) Regulations 2010 (“Regulations”), I, Mark Stephen Wogan, Manager, Energy Safety – High Hazards, Energy and Public Safety, WorkSafe New Zealand (“WorkSafe”), give the following notice:

1. Short Title and Commencement

1. This notice is the Electricity (Safety) Regulations (Unsafe Misting Fan) Notice 2020.
2. This prohibition is to take effect on and from the date of publication of this notice in the New Zealand Gazette.

2. Prohibited Equipment

This notice applies to the Misting Fan, Model: DB26CF02 (“prohibited appliance”) which:

1. has been supplied by DW Johnson Family Trust trading as Cool Air Solutions 2019;
2. has been marketed and sold by Cool Air Solutions 2019;
3. has known markings that include “SAA SGS-161095-EA” and “DB26CF02”, which correspond to the fan’s certification and model number respectively; and
4. has the following characteristics:
• it is typically black in colour with a blue or black water tank
• it is 2m in height
• it has a 26″ (inch) fan
• it is upright in appearance
• it has a water tank attached at the base.

The following images show a sample of the prohibited appliance and a close up view of the markings for identification purposes.

3. Prohibition

The sale (including an offer to sell), or use (including installation) of the prohibited appliance is prohibited.

4. Reasons for Prohibition

1. WorkSafe believes that the prohibited appliance is, or may be, electrically unsafe in that there is significant risk that a person may suffer harm as a result of dangers arising from use of, or passage of electricity through the disconnection of, the interconnecting leads.
2. The reasons for believing the prohibited appliance is or may be unsafe are that:
1. the appliance is not constructed so as to be safe under both normal and abnormal conditions; and
2. the appliance has interconnecting leads which can be easily removed, without the use of a tool, exposing live conductive parts that a person can come into direct contact with.
