Notice is hereby given that the Auckland Council, under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the First Schedule of this notice (“Land”).
The Land is required for road for the Auckland Manukau Eastern Transport Initiative (AMETI) Project.
The reasons why the Auckland Council considers it reasonably necessary to take the Land is to construct, operate and maintain an alternative access road via Domain Road to several properties located at Lagoon Drive. The existing access way from Lagoon Drive will be severed in accordance with the requirements of the AMETI Project.
The AMETI Project is required to provide:
- a safe, integrated multi-modal transport system that supports population and economic growth in East Auckland by providing improved alternative modes of transport; and
- a busway along the northern side of Lagoon Drive; a pedestrian and cycle path along the northern side of Lagoon Drive; separate pedestrian and cycle paths along the northern side of Pakuranga Road; and an additional bridge across the Tamaki River to the north of and parallel with the existing Panmure Bridge.
The designation for the AMETI Project is included in the district plan and includes the Land for roading purposes.
The owner of the Land and those with a registered interest in it have been served notice of the Auckland Council’s intention to take the Land and have been advised of their rights to object.
Any other person has the right to object may send a written objection to the Registrar, Environment Court, Specialist Courts and Tribunals Centre, Level 2, 41 Federal Street, Auckland 1010. Postal Address: PO Box 7147, Wellesley Street, Auckland 1141, within 20 working days after the date of publication of this notice.
If any objection is made in accordance with this notice, a public hearing will be held. The objector will have a right to appear and be heard personally unless the objector otherwise requires. Each objector will be informed of the time and place of the hearing.
