Wildlife (Pheasant and Red-legged Partridge) Notice 2019

Pursuant to section 6 of the Wildlife Act 1953, the Minister of Conservation gives the following notice.

1 Title

This notice is the Wildlife (Pheasant and Red-legged Partridge) Notice 2019.

2 Commencement

This notice comes into force on 10 August 2019.

3 Expiry of Notice

This notice expires and is revoked at the close of 6 May 2022.

4 Interpretation

(1) In this notice, unless the context requires otherwise,—

Central South Island Fish and Game Region means the area so described in the New Zealand Gazette, 24 May 1990, No. 83, page 1861, as amended by the New Zealand Gazette, 29 August 1991, No. 129, page 2786, and as further amended by the New Zealand Gazette 3 September 1992, No. 141, page 2958.

Hawke’s Bay Fish and Game Region means the area so described in the New Zealand Gazette, 24 May 1990, No. 83, page 1861.

West Coast Fish and Game Region means the area so described in the New Zealand Gazette, 24 May 1990, No. 83, page 1861.

(2) Unless the context requires otherwise, terms used in this notice have the same meaning as in the Wildlife Act 1953.

5 Scope of notice

(1) This notice applies only to specified areas listed in Part 2 of Schedule 3 of the Wildlife Act 1953.

(2) This notice imposes conditions on—

(a) the hunting or killing of pheasants and red-legged partridge in the specified areas; and

(b) the removal of pheasants and red-legged partridge from those areas.

6 Pheasant and red-legged partridge may be hunted or killed or possessed

A person may hunt or kill or possess pheasant and red-legged partridge—

(a) during the periods specified in clause 7; and

(b) subject to the conditions specified in clauses 8 to 10.

7 Seasons and times birds may be hunted

(1) A person may hunt or kill pheasant and red-legged partridge during the period from the first Saturday in May to the last Sunday in August each year.

(2) A person may hunt or kill pheasant in the Hawke’s Bay Fish and Game Region during the period from the last Sunday in August to 30 September each year.

(3) A person may hunt or kill pheasant and red-legged partridge in the Hawke’s Bay Fish and Game Region and the Central South Island Fish and Game Region during the period from 1 April to the first Saturday in May each year.

(4) A person may hunt or kill pheasant in the West Coast Fish and Game Region during any month of each year.

(5) A person may only hunt or kill pheasant and red-legged partridge during the period beginning 30 minutes before sunrise and ending 30 minutes after sunset.

8 Shotgun must be used

A person must not hunt or kill a pheasant or red-legged partridge except by using a shotgun of calibre 10 gauge or less.

9 Shooting of birds not in flight prohibited

(1) A person must not shoot at or attempt to shoot at a pheasant or red-legged partridge, except when the bird is in flight or if the bird is already wounded by shooting.

(2) For the purposes of this clause—

(a) a bird is deemed not to be in flight at any time when it is alighting on or rising from any water or land, or any vegetation or structure in or on any water or on any land, and any part of the bird is in contact with the water or land or vegetation or structure.

(b) subject to paragraph (a), a bird is deemed to be in flight at all times when it is airborne, including times when it is soaring or banking or swooping, and whether its wings are in motion or not.

10 Labelling of birds removed from specified area

A person must not have in his or her possession outside a property listed in Part 2 of Schedule 3 of the Wildlife Act 1953, any pheasant or red-legged partridge taken from that listed property, unless affixed to the bird is a label with the name of the listed property where that bird was taken or killed, and the date on which the bird was taken or killed, written legibly on it.
