Amendment of Notice of Direction to Appoint a Limited Statutory Manager for the Ngata Memorial College (206) Board of Trustees

Under section 78M(6) of the Education Act 1989, the notice published in the New Zealand Gazette, 19 March 2015, Issue No. 26, Notice No. 2015-go1623, as amended by the notice published in the New Zealand Gazette, 29 June 2017, Issue No. 69, Notice No. 2017-go3295, directing the Secretary for Education to appoint a limited statutory manager for the Ngata Memorial College (206) Board of Trustees is further amended by vesting the following functions, powers and duties of the board in the limited statutory manager.

  1. The following functions, powers and duties of the board are to be vested in the limited statutory manager:
    1. All functions, powers and duties of the board as an employer (whether statutory or otherwise);
    2. all functions, powers and duties of the board in curriculum management including teaching and assessment practice (whether statutory or otherwise); and
    3. all functions, powers and duties of the board to establish policies and procedures in planning and reporting (whether statutory or otherwise).
  2. No other functions, powers or duties are vested in the limited statutory manager.
  3. The board will retain its primary duty of care as a person conducting a business or undertaking, under the Health and Safety at Work Act 2015, above and beyond all functions, powers and duties of this limited statutory manager.

This notice takes effect on the date of publication.
