Fisheries (Tuhawaiki, Te Ahi Tarakihi, Waitarakao Mātaitai Bylaws) 2019 (Notice No. MPI 973)
Pursuant to Regulations 25 and 26 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries hereby publishes the following bylaws which he has approved.
These bylaws may be cited as the Fisheries (Tuhawaiki, Te Ahi Tarakihi, Waitarakao Mātaitai Bylaws) 2019.
These bylaws come into effect on 24 June 2019.
In these bylaws:
The Minister of Fisheries has approved the following bylaws for the Tuhawaiki Mātaitai:
Bylaw 1 – Maximum daily limits on shellfish stocks – Tuhawaiki Mātaitai
No person may, on any day, take more than:
from within the Tuhawaiki Mātaitai.
Bylaw 2 – Prohibition on the harvesting of shellfish stocks – Tuhawaiki Mātaitai
No person may, on any day, take shellfish (other than pāua, kina or kūtai (mussels)) from within the Tuhawaiki Mātaitai.
The Minister of Fisheries has approved the following bylaws for Te Ahi Tarakihi Mātaitai:
Bylaw 1 – Maximum daily limits on shellfish stocks – Te Ahi Tarakihi Mātaitai
No person may, on any day, take more than:
from within Te Ahi Tarakihi Mātaitai.
Bylaw 2 – Prohibition on the harvesting of shellfish stocks – Te Ahi Tarakihi Mātaitai
No person may, on any day, take shellfish (other than pāua, kina or kūtai (mussels)) from within Te Ahi Tarakihi Mātaitai.
Bylaw 3 – Maximum daily limit on pātiki (flatfish) – Te Ahi Tarakihi Mātaitai
No person may, on any day, take more than ten (10) pātiki (flatfish) (Rhombosolea plebeia; Pelotretis flavilatus; Peltorhamphus novaezeelandiae; Rhombosolea leporina; Colistium guntheri; Colistium nudipinnis; Rhombosolea retiaria; Rhombosolea tapirine) from within Te Ahi Tarakihi Mātaitai.
The Minister of Fisheries has approved the following bylaw for the Waitarakao Mātaitai:
Bylaw 1: Maximum daily limit on pātiki (flatfish) – Waitarakao Mātaitai
No person may, on any day, take more than ten (10) pātiki (flatfish) from within the Waitarakao Mātaitai.

Under Regulation 25(3) of the Fisheries (South Island Customary Fishing) Regulations 1999, these bylaws apply generally to all persons fishing in the Tuhawaiki, Te Ahi Tarakihi, or Waitarakao Mātaitai.
Under Regulation 43 of the Fisheries (South Island Customary Fishing) Regulations 1999, a person commits an offence against those Regulations if a person breaches these bylaws.
