Notice Pursuant to Section 70 of the Land Transfer Act 1952

An application, under section 70 of the Land Transfer Act 1952, has been received for the removal of an easement. The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 13 July 2018, the Register will be updated to record the easement as redundant.

Easement: Right to convey water marked AO on SO 455144 over Section 5 SO 455144 contained in CT 628093 (servient tenement) appurtenant to Lot 2 DP 470387 contained in CT 801244, a right to convey water marked M on SO 455144 over Section 4 SO 455144 contained in CT 628093 (servient tenement) appurtenant to Sections 13 and 16 SO 455144, Lot 2 DP 470387 and Lot 5 DP 470387 contained in CTs 636067, 636068, 636070 and 801244 (dominant tenements), a right to convey water marked N and O on SO 455144 over Section 4 SO 455144 contained in CT 628093 (servient tenement) appurtenant to Lots 2 and 5 DP 470387 contained in CTs 636070 and 801244 (dominant tenements) and a right to convey water marked AR on SO 455144 over Section 4 SO 455144 contained in CT 628093 (servient tenement) appurtenant to Sections 13 and 16 SO 455144 and Lot 2 DP 470387 contained in CTs 636067, 636068 amd 801244 created by Easement Instrument 9610942.7 registered on 6 January 2014.

Circumstances: The easement has expired as AE Field & Sons Limited has ceased to be registered proprietor of the land (dominant tenements) adjoining the servient tenement.
