The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a right of way easement. The applicant claims the right of way easement is redundant by reason of the circumstances set out below.

I intend to remove the right of way easement on 16 February 2018 if no objections have been received before that date.

Applicant: Roy Robert James Fear and Ann Christine Fear, c/- Paul McGarry, Hill Lee & Scott, Level 1, Tourism House, 36 Sir William Pickering Drive, Burnside, Christchurch 8053.

Easement: A right of way over part Lot 1 DP 18760 appurtenant to Lot 2 DP 70923 created by Transfer 507038 – 20.8.1959 at 11.18am.

Circumstances: The dominant land has become physically separated from the servient land as a result of the subdivision of plan DP 70923.
