Notice is hereby given that Tasman District Council (“Council”) proposes, under the Public Works Act 1981, to take the land described in the Schedule of this notice (“land”).

The land is required for the Richmond South Stormwater Upgrade–Bateup Drain Project (“project”). More particularly, the land is required for drainage purposes.

The project is required to improve the existing open drainage system with a wider and properly engineered open drainage system as part of what is known as the Bateup drain connecting into the Reed/Andrews drain and then Borck Creek, such integrated drainage system flowing from the Richmond foothills in the south northward to Headingly Land and then to the Waimea Estuary. This particular section of drain requires completion to protect land within the adjoining Hart Rise subdivision and surrounding properties from flooding in a significant storm event. The land is also required for provision of open space and recreation reserve areas along the drain margins.

The owner of the land has been served with notice of Council’s intention to take the land and advised of their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, 5th Floor, District Court Building, 49 Ballance Street, Wellington 6011, or by post to DX SX11154, Wellington, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires and each objector will be informed of the time and place of the hearing.
