Easement Acquired for Drainage Purposes—State Highway 2, Havelock North, Hastings District

Pursuant to sections 20(1) and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Kavya Shrivastava, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, a right to drain sewage easement in gross described in the Second Schedule to this notice is acquired over the land of The Bivvy Limited (“Grantors”) described in the First Schedule to this notice upon the terms and conditions set out in the Third Schedule to this notice and shall vest in the Hastings District Council (“Grantee”) in gross on the date of publication of this notice in the New Zealand Gazette.

Lot 1 DP 28764 (Computer Freehold Register HBY3/207).

Second Schedule

Easement to be Acquired

A Right to Drain Sewage easement in gross over that part of Lot 1 DP 28764 marked “B” on SO Plan 526930 (“Easement”).

Third Schedule

Rights and Powers:

The Easement shall contain the rights and powers implied into such easements as set out in the Fourth Schedule to the Land Transfer Regulations 2002 including the right for the Council to enter upon the easement land with or without engineers, contractors and workers for the purposes of constructing, inspecting, maintaining and replacing the sewer on the easement land.
