Pursuant to section 47(1)(a) of the Ngatikahu ki Whangaroa Claims Settlement Act 2017 (“Act”), the Minister of Conservation (“Minister”) hereby notifies that the area described in the Schedule hereto has been declared to be subject to an overlay classification by section 42(1) of the Act.

The provisions of the Act which relate to the overlay classification are sections 41–55.

Pursuant to section 47(1)(b) of the Act, the Minister hereby notifies that the following protection principles are directed at the Minister avoiding harm to, or the diminishing of, Ngatikahu ki Whangaroa values related to Whakaangi (being Whakaangi Scenic Reserve):

1. respect for Ngatikahu ki Whangaroa tikanga and kaitiakitanga within the Reserve;
2. recognition of Ngatikahu ki Whangaroa mana, kaitiakitanga, tikanga/kawa over and within the Reserve;
3. protection of wahi tapu, significant places, indigenous flora and fauna, water and the wider environment of the Reserve;
4. respect for and recognition of the relationship of Ngatikahu ki Whangaroa with the wahi tapu and significant places;
5. encouragement of recognition and respect for the particular Ngatikahu ki Whangaroa association with the Reserve;
6. accurate portrayal of the association and kaitiakitanga relationship of Ngatikahu ki Whangaroa with the Reserve;
7. recognition of Ngatikahu ki Whangaroa’s interest in actively protecting indigenous species with the Reserve; and
8. protection of indigenous traditional materials and resources, and recognition of the importance of Ngatikahu ki Whangaroa access to those materials and resources for customary use.
