Initiation of Reconsideration of Subsidy Investigation: Galvanised Steel Coil From China
Pursuant to the direction of the High Court and to section 10 of the Dumping and Countervailing Duties Act 1988, and acting under delegated authority from the Chief Executive of the Ministry of Business, Innovation and Employment, I have initiated a reconsideration of the alleged subsidisation of the goods described in the Schedule of this notice (“goods”). This initiation follows the judgment of the High Court in New Zealand Steel Ltd v Minister of Commerce and Consumer Affairs [2018 NZHC 2454 (18 September 2018)] which quashed the then Minister of Commerce and Consumer Affair’s original determination of 5 July 2017, and directed that the reconsideration be conducted in light of the reasons set out in the judgment for the quashing of the Minister’s decision, and on the basis of the Dumping and Countervailing Duties Act 1988 as it stood at the time.
People’s Republic of China.
Galvanised steel coil with a thickness equal to or greater than 0.3mm and less than or equal to 1.9mm and a width greater than 600mm but not greater than 1260mm, with a hot dipped galvanised (zinc) coating.
During the period of investigation for the reconsideration the goods were classified under Tariff Item 7210.49.31 and Statistical Keys 01 and 09, and are currently classified under Tariff Item 7210.49.31 and Statistical Keys 43, 45, 47, 49, 51 and 53, which classifications are provided for convenience and Customs’ purposes only, the written description being dispositive.
