Pursuant to Regulations 25 and 26 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries hereby approves and publishes the following bylaws.

Bylaws

1. Title—These bylaws may be cited as the Fisheries (Declaration of Moeraki Mātaitai Reserve Bylaws) 2018.
2. Commencement—These bylaws comes into effect 28 days after the date of its notification in the New Zealand Gazette.
3. Interpretation—In these bylaws:
   1. The term “Moeraki Mātaitai Reserve” means that mātaitai reserve at Moeraki described in the Fisheries (Declaration of Moeraki Mātaitai Reserve) Notice 2010, notified in the New Zealand Gazette, 18 November 2010, No. 154, page 3837.
   2. Unless the context requires otherwise, terms have the same meaning as in the interpretation sections of the Fisheries (South Island Customary Fishing) Regulations 1999 and the Fisheries Act 1996.
4. Approval of bylaws for the Moeraki Mātaitai Reserve—The Minister of Fisheries has approved the following bylaws for the Moeraki Mātaitai Reserve:

Bylaw 1 – Daily Limit for Pāua fishing in the Moeraki Mātaitai Reserve

No person may, on any day, take more than three (3) pāua (both blackfoot – Haliotis iris and yellowfoot – Haliotis australis) from the Moeraki Mātaitai.

Bylaw 2 – Prohibition on taking pāua from the Turaka Waka and Tikoraki/Tawhiroko areas within the Moeraki Reserve.

1. No person may, on any day, take any pāua (both blackfoot – Haliotis iris and yellowfoot – Haliotis australis) from the Turaka Waka and Tikoraki/Tawhiroko areas lying within the Moeraki Mātaitai Reserve.
2. For the purposes of this bylaw, the Turaka Waka area commences at a point at approximately 45023.601″S 170052.099″E; then following the mean high-water springs mark in a southerly direction to a point at approximately 45023.668″S 170052.107″E; then proceeding due east for approximately 200m to a point at approximately 45023.668″S 170052.221″E; then proceeding due north to a point at approximately 45023.601″S 170052.220″E; then proceeding due west to the point of commencement.
3. For the purposes of this bylaw, the Tikoraki/Tawhiroko area commences at a point at approximately 45022.265″S 170052.078″E; then proceeding due east to the seaward boundary of the mātaitai at approximately 45022.265″S 170052.212″E; then proceeding north-northwest to a point at approximately 45022.160″S 170052.211″E; then proceeding northwest to a point at approximately 45021.895″S 170052.092″E then proceeding west southwest to a point on the mean high-water springs mark at approximately 45021.951″S 170051.780″E then following the mean high-water springs mark to the point of commencement.

Explanatory note

Bylaw 1 subject to Bylaw 2

Bylaw 1 is subject to Bylaw 2, as the 3 pāua allowance prescribed by Bylaw 1 does not apply in respect of the areas described in Bylaw 2.

Fishing subject to these bylaws

Under Regulation 25(3) of the Fisheries (South Island Customary Fishing) Regulations 1999, these bylaws apply generally to all persons fishing in the Moeraki Mātaitai Reserve.

Breach of bylaws is an offence

Under Regulation 43 of the Fisheries (South Island Customary Fishing) Regulations 1999, a person commits an offence against those Regulations if a person breaches these bylaws.
