Notice of Application to Vary Terms of a Charitable Trust
Pursuant to Section 36 of the Charitable Trusts Act 1957
In the High Court of New Zealand, Wellington Registry:
In the matter of the Charitable Trusts Act 1957, and in the matter of an application by Gregory Malcolm Knight, Elizabeth Estelle Binns and Sandra Mary Kirby (“applicants”) as trustees of THE NEW ZEALAND SOCIETY OF PHYSIOTHERAPISTS SCHOLARSHIP TRUST (“trust”).
Take notice that on 1 October 2018 at 10.00am, or as soon thereafter as counsel may be heard, the applicants will apply to the High Court at Wellington for an order approving a scheme to vary the terms of the trust.
The purpose of the application is to update the trust deed to express the powers and responsibilities of the trustees in a more modern and clearer form.

The trust’s scheme and the Attorney-General’s report are also available for inspection free of charge at the Wellington High Court.
Any person desiring to oppose the scheme must give written notice of his or her intention to do so to:
- the Registrar of the High Court at Wellington;
- the applicants at the address for service below; and
- the Attorney-General at the Crown Law Office, PO Box 2858, Wellington
not less than seven clear days before the matter is due to be heard.
