Notice of Exemption From Maritime Rules

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions from the Maritime Rules for the period 9 October 2018 and 20 November 2018 inclusive:

  • 5 from Rule 31.25(1) – Crewing and Watchkeeping – General crewing and other requirements – Duty of crew to hold certificates and to be able to demonstrate ancillary proficiencies – Specific certificate or endorsement or higher grade of certificate or endorsement
  • 1 from Rule 31.43(1)(a) – Crewing and Watchkeeping – SOLAS and STCW ships – Unlimited area – Requirements for ships operating in unlimited areas to carry at least navigational watchkeepers as specified
  • 1 from Rule 31.44 – Crewing and Watchkeeping – SOLAS and STCW ships – Coastal and offshore limits – Ships operating beyond restricted limits but within coastal limits or offshore limits must carry navigational or engine room watchkeepers
  • 6 from Rule 31.84(2)(b) – Crewing and Watchkeeping – Minimum crewing requirements for other ships – Seafarers holding minimum required certificates and minimum number of crew specified applicable table and flowchart

  • 1 from Rule 40A.9(3) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Ships post-27 May 2004 of 7.5 metres or more in length must be constructed under survey
  • 1 from Rule 40A.13(2), Appendix 1, 1.2(7)(a)(ii) and 1.2(7)(b) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Intact stability of decked ships – Inclining test and stability criteria – GZ curve must not be less than the metre-radians specified
  • 1 from Rule 40A.21(1)(a), Table 40A.3 – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Toilet facilities – Toilet facilities required by Table 40A.3 for unberthed passengers on ships proceeding beyond the coastal limits
  • 1 from Rule 40A.40(1)(b) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Electrical systems – For ships 24 metres or less in length overall – Compliance with applicable parts of the AS/NZS 3004.2 Electrical installations – Marinas and Boats
  • 1 from Rule 40C.13(1), Appendix 1, 1.2(4) – Design, Construction and Equipment – Non-Passenger Ships that are not SOLAS Ships – Intact stability of post-27 May 2009 fully decked ship – Must be determined from results of an inclining experiment
  • 1 from Rule 40D.30C(1)(b) – Design, Construction and Equipment – Fishing Ships – Electrical systems – For ships 24 metres or less in length overall – Compliance with applicable parts of the AS/NZS 3004.2 Electrical installations – Marinas and Boats
  • 1 from Rule 40D.37(1), Appendix 1, 1.1, rescue boats – Design, Construction and Equipment – Fishing Ships – Life-saving appliances – Unlimited ships – Provision of life-saving appliances only in respect of SOLAS rescue boats that comply with Rule 42A.14
  • 1 from Rule 91.5(1) – Navigation Safety Rules – Operating requirements – Minimum age for operating powered vessels – No person under the age of 15 years shall be in charge of, or propel or navigate a power driven vessel unless under direct supervision
  • 1 from Rule 91.5(2) – Navigation Safety Rules – Operating requirements – Minimum age for operating powered vessels – Owner of power driven vessel must not allow any person under the age of 15 years be in charge of or propel or navigate the vessel unless under direct supervision
