Notice of Exemption From Maritime Rules

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions from the Maritime Rules for the period 19 June 2018 to 31 July 2018 inclusive:

  • 1 from Rule 19.3 – Maritime Transport Operator – Certification and Responsibilities – Requirement to hold Maritime Transport Operator Certificate
  • 1 from Rule 19.41 – Maritime Transport Operator – Certification and Responsibilities – Maritime Transport Operator Plan requirements
  • 1 from Rule 19.42(1) – Maritime Transport Operator – Certification and Responsibilities – Develop and document maritime transport operator safety system in the Maritime Transport Operator Plan
  • 1 from Rule 19.43(1) – Maritime Transport Operator – Certification and Responsibilities – Develop and apply a survey plan
  • 1 from Rule 19.45(1) – Maritime Transport Operator – Certification and Responsibilities – Develop and apply a maintenance plan
  • 1 from Rule 19.46(1) – Maritime Transport Operator – Certification and Responsibilities – Develop relevant safety equipment list and a spare parts list
  • 1 from Rule 19.62(1) – Maritime Transport Operator – Certification and Responsibilities – No person may operate or permit the operation of a ship in the maritime transport operation unless the ship has a valid Certificate of Survey issued under Rule 44.41

  • 1 from Rule 40A.9(3) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Ships post-27 May 2004 of 7.5 metres or more in length must be constructed under survey
  • 1 from Rule 40A.55(1) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Fire fighting appliances – Owner and master of a ship must ensure fire appliances are provided in accordance with requirements of Appendix 3
  • 1 from Rule 40A.56(1) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Life-saving appliances

  • 2 from Rule 47.8(2)(a) – Load Lines – Owner’s and master’s obligations – Owner and master must comply with and ensure compliance with this Section and the provisions of Articles 2, 3, 7, 10 to 15, Annex I and Annex II of the Load Line Convention
  • 1 from Rule 47.8(2)(b)(i) – Load Lines – Ships of 24 metres or more in length – Owner’s and master’s obligations – Ships not proceed on voyage unless surveyed, maintained and marked in accordance with this section and Load Line Convention
  • 1 from Rule 50.9(1) – Medical Stores – Scale 4 – Rule 50.9 applies to any ships operating in the unlimited area
  • 1 from Rule 73.4(1) – Logbooks – Requirement to carry a New Zealand official logbook on board the ship in the form specified
  • 1 from Rule 82, Appendix 1, 1.12(c) – Commercial Jet Boat Operations (River) – Operating details, procedures, and programmes to be included in Commercial Jet Boat Safe Operational Plan – Navigational safety – Commercial jetboats must keep to right unless safety otherwise dictates
  • 1 from Rule 82.41, Appendix 2, 2.17.1 – Commercial Jet Boat Operations (River) – Commercial jet boat standards – Personal flotation devices – Each person on board must be provided with a personal flotation device
  • 1 from Rule 82.41, Appendix 2, 2.17.2 – Commercial Jet Boat Operations (River) – General requirements – Personal flotation devices must be of a type 401, type 402, or type 406 specialist personal flotation device
  • 1 from Rule 82.41, Appendix 2, 2.18.1(a)(iii), 2.18.1(b) and 2.18.1(d) – Commercial Jet Boat Operations (River) – Commercial jet boat standards – Other equipment to be carried on commercial jet boats – Rope permanently attached to bow eye, spare plug for any drain hole, and three hand-held flares complying with maritime rule 42A.23
