Electricity Industry (Exemption No. 268 (Trustpower Limited)) Exemption Notice 2018

Under section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 268 (Trustpower Limited)) Exemption Notice 2018.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption—(1) Trustpower Limited (“Trustpower”) is exempted from complying with the obligation in clause 11 of Schedule 15.3 of the Electricity Industry Participation Code 2010 (“Code”) to maintain a distributed unmetered load database (DUML) for 30 installation control points (ICPs).

(2) This exemption applies only to the following ICPs:

3. Term
—This exemption expires on the close of 30 April 2020.

4. Reasons for granting the exemption—The reasons for granting this exemption are:

  1. without the exemption, Trustpower will incur significant set up, maintenance, and annual compliance costs associated with a DUML database;
  2. Trustpower only needs the exemption on a short-term basis while it implements an alternative solution by assigning unique ICP identifiers to all of the telecommunications cabinets and complying with the unmetered load obligations of the Code;
  3. the exemption will have no impact on any other participants and service providers, and will not affect any other Code provisions; and
  4. granting the requested exemption meets the requirements in section 11(2) of the Act.
