Notice of Exemption from Maritime Rules

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions from the Maritime Rules for the period 27 April 2018 to 8 June 2018 inclusive:

  • 1 from Rule 19.62(1) – Maritime Transport Operator – Certification and Responsibilities – No person may operate or permit the operation of a ship in the maritime transport operation unless the ship has a valid Certificate of Survey issued under Rule 44.41
  • 1 from Rule 19.63(1)(b) – Maritime Transport Operator – Certification and Responsibilities – Survey requirements – must ensure surveyor completes surveys for each ship, including any barge that carries persons or passengers on board
  • 3 from Rule 25.4 – Nautical Charts and Publications – area requirements – owner and master of vessel must ensure nautical charts, nautical publications, IAMSAR manual, and tables, are carried on the vessel
  • 1 from Rule 31.25(1) – Crewing and Watchkeeping – General crewing and other requirements – duty of crew to hold certificates and to be able to demonstrate ancillary proficiencies – specific certificate or endorsement or higher grade of certificate or endorsement
  • 1 from Rule 31.84(2)(b) – Crewing and Watchkeeping – Minimum crewing requirements for other ships – seafarers holding minimum required certificates and minimum number of crew specified applicable table and flowchart
  • 1 from Rule 31.84(2)(b)(i) – Crewing and Watchkeeping – Ships other than ships to which subparts C and D apply – Minimum crewing requirements for other ships – seafarers on board hold minimum requirement certificates and prescribed endorsements
  • 1 from Rule 31.84(4)(b), Table 11 – Crewing and Watchkeeping – Minimum crewing requirements for other ships – applicable tables and flow-charts for passenger ships operating within enclosed water limits – only in relation to ship length < 24m with passenger endorsement - Master SRL

  • 2 from Rule 32.10(1) – Seafarer Certification – Administration of certificates and associated endorsements – requirement to hold certificate and associated endorsements
  • 2 from Rule 40A.7(1)(a) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – for ships post-27 May 2004, owner of ship must ensure ship’s design is approved by a surveyor who holds a current Certificate of Surveyor Recognition
  • 2 from Rule 40A.9(3) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – ships post-27 May 2004 of 7.5m or more in length must be constructed under survey
  • 1 from Rule 40A.12(4)(a) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Doorways and other access openings must not be fitted in the collision bulkhead below the freeboard deck
  • 1 from Rule 40A.13(2), Appendix 1, 1.2(4) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – intact stability of decked ships – inclining test and stability criteria must be determined from results of an inclining experiment
  • 1 from Rule 40A.25(1)(b), Table 40.5 – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – height of guard rails or bulwarks above the deck on decks to which passengers have access must be not less than the height shown in Table 40A.5
  • 2 from Rule 40A.55(1) – Design, Construction and Equipment – Passenger Ships which are not SOLAS Ships – Fire-fighting appliances – Owner and master of a ship must ensure fire appliances are provided in accordance with requirements of Appendix 3.

  • 1 from Rule 40C.13(1), Appendix 1, 1.2(4) – Design, Construction and Equipment – Non-Passenger Ships that are not SOLAS Ships – intact stability of post-27 May 2009 fully decked ship – must be determined from results of an inclining experiment
  • 1 from Rule 40C.51(1) – Design, Construction and Equipment – Non-Passenger Ships that are not SOLAS Ships – provision of fire appliances in accordance with requirements of Appendix 2.
  • 1 from Rule 40C.51(4) – Design, Construction and Equipment – Non-Passenger Ships that are not SOLAS Ships – ensure all fire appliances are in working order and ready for immediate use before ship commences a voyage and at all times during the voyage
  • 1 from Rule 40C.52(1) – Design, Construction and Equipment – Passenger Ships that are not SOLAS Ships – provision of life-saving appliances in accordance with requirements of Appendix 3.
  • 1 from Rule 40C.53(1) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS Ships – provision of radiocommunication equipment must be provided on a ship proceeding beyond enclosed waters in accordance with requirements of Appendix 4.
  • 1 from Rule 40E.50(1) – Design, Construction and Equipment – Sailing ships – fire-fighting appliances – provision of fire-fighting appliances and compliance with requirements, including maintenance, inspection and service
  • 2 from Rule 40E.51(1) – Design, Construction and Equipment – Sailing ships – life-saving appliances – provision of life-saving appliances and compliance with requirements, including maintenance, inspection and service
  • 1 from Rule 40E.52(1) – Design, Construction and Equipment – Sailing ships – provision of radiocommunications equipment in accordance with Appendix 5 requirements
  • 1 from Rule 40E.52(2) – Design, Construction and Equipment – Sailing ships – radiocommunications equipment must meet prescribed performance standard and is maintained, inspected, and serviced

  • 2 from Rule 45.21(1)(a)(i) – Navigational Equipment – Magnetic compasses – Small passenger and non-passenger ships, fishing ships – passenger ship less than 150 tons gross tonnage and proceeds beyond restricted limits must be fitted with a magnetic compass capable of being adjusted
  • 3 from Rule 45.5(1) – Navigational equipment – All New Zealand ships – sextant, chronometer, and binoculars – ships proceeding beyond unlimited area must be provided with at least one sextant
  • 3 from Rule 45.5(2) – Navigational equipment – All New Zealand ships – sextant, chronometer, and binoculars – ships proceeding beyond unlimited area must be provided with at least one chronometer
  • 1 from Rule 45.29(5) – Navigational equipment – Ships of 500 tons gross tonnage or more to which SOLAS is not applied – Ship that proceeds into unlimited area must have a radar installation capable of operating in the 9 GHz band
  • 1 from Rule 47.65(2) – Load Lines – Ships of less than 24m in length – Conditions of assignment – Height from deck of coamings must be of substantial construction
  • 4 from Rule 50.9(1) – Medical Stores – scale 4 – Rule 50.9 applies to any ships operating in the unlimited area
  • 2 from Rule 73.4(1) – Logbooks – requirement to carry a New Zealand official logbook on board the ship in the form specified
  • 1 from Rule 82.41, Appendix 2, 2.17.2 – Commercial Jet Boat Operations (River) – general requirements – personal flotation devices must be of a type 401, type 402, or type 406 specialist personal flotation device
