Under section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority (“Authority”) gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 267 Financial Corporation Limited)) Exemption Notice 2018.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption—Financial Corporation Limited (“FCL”) is exempted from complying with the obligation in clause 7(1) of Schedule 11.4 of the Electricity Industry Participation Code 2010 (“Code”) to provide to the registry manager the information indicated in lines 23 to 30 of Table 1.

3. Term—This exemption expires on the close of 31 May 2020.

4. Reasons for granting the exemption—The reasons for granting this exemption are:

1. the metering records FCL will be exempt from providing to the registry manager are records that The Lines Company Limited uses only for network billing purposes;
2. the exemption will have little or no impact on any other participants and service providers, and will not affect any other Code provisions;
3. the exemption is only needed on a short-term basis while the Authority considers a Code amendment to address the issue; and
4. granting the requested exemption meets the requirements in section 11(2) of the Act.
