In accordance with section 11(3) of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 168 (Arc Innovations Limited)) Exemption Amendment Notice 2018.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Amendment to principal exemption—Replace clause 3 of the Electricity Industry (Exemption No. 168 (Arc Innovations Limited)) Exemption Notice 2013, published in the New Zealand Gazette, 11 July 2013, No. 88, page 2359 (“principal exemption”) with:

“3. Term—This exemption expires at the close of 31 December 2025.”

3. Reasons for this amendment—The reasons for amending the principal exemption are:

1. amending the exemption meets the requirements in section 11(3) of the Act for amending exemptions;
2. traders supplying installation control points (“ICPs”) that use Arc Innovations Limited’s first generation advanced metering infrastructure (“AMI”) metering installations will incur higher administration and compliance costs in changing their internal systems to align existing customer metering records with the new serial numbers in the registry;
3. the amendment will avoid a negative impact on customer switching; and
4. the exemption will have no impact on consumers, service providers, or other traders supplying ICPs that do not use Arc’s first generation AMI metering installations, and will not affect any other provisions of the Electricity Industry Participation Code 2010.
