The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of an effluent disposal easement.
The applicant claims the effluent disposal easement is redundant by reason of the circumstances set out below.
I intend to remove the effluent disposal easement described below on 27 March 2017 if no objections have been received before that date.
Applicant: Judith Anne Livingstone, c/o David Gray, Daniel Overton & Goulding, 33 Selwyn Street (PO Box 13017), Onehunga, Auckland 1643.
Easement: An effluent disposal easement over part marked “G” on DP 326585 appurtenant to Lots 8–12 and 14 DP 326585 created by Easement Instrument 5770284.13 – 20 October 2003 at 9.00am.
Circumstances: A community sewage scheme has been established by the Kaipara District Council to serve the dominant tenements and the connections have become available to such a scheme.
