An application under section 70 of the Land Transfer Act 1952 has been received for the removal of an easement.

The applicants claim the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 21 November 2017, the Register will be updated to record the easement as redundant.

Applicants: Kerry Stuart Francis and Judith Margaret Mitchell, c/o Haigh Lyon, PO Box 119, Auckland 1140.

Easement: Right of way over part Crown Land marked “E” and “F” on SO 55265, and a water pipeline easement over part Crown Land marked “A” on SO 55265 and over part Allotment 235 Parish of Wairau marked “B” and “C” on SO 55265, and a right to transmit power over part Allotment 235 Parish of Wairau marked “C” and “D” on SO 55265 appurtenant to Allotment 234 and 238 Parish of Wairau comprised in NA67B/654 created by Deed of Easement B104407.1 registered on 8 September 1982.

Circumstances: The easement has ceased due to the cancellation of the lease comprised in NA51D/833 by the registration of certificate under section 116 of the Land Act 1948 B839782.1 on 16 June 1988.
