The applicant claims the drain sewage easement is redundant by reason of the circumstances set out below.

Easement: A drain sewage easement over part marked “A-B-C” on DP 337523 comprised in Computer Freehold Register 154102 as appurtenant to Lot 1 DP 486065 comprised in Computer Freehold Register 692288, created by Transfer 110127 – 6 August 1916 at 2.42pm.

Circumstances: The dominant land has become physically separated from the servient land as a result of subdivision shown on DP 486065.
