The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of an easement.
The applicants claim the easement is redundant by reason of the circumstances set out below.
If no objections have been received before 26 June 2017, the Register will be updated to record the easement as redundant.
Applicants: Angela Mae Waters and Gregory Dean Waters, c/o ASCO Legal, PO Box 3695, Shortland Street, Auckland 1149.
Easement: Right of way over part Lot 1 DP 165238 marked “A” on DP 167428 comprised in Computer Registers NA99D/209 and NA102B/59 appurtenant to Lot 2 DP 180747 comprised in Computer Register NA111D/529 specified in Easement Certificate C901583.4 registered on 28 September 1995.
Circumstances: The dominant tenement has become physically separated from the servient tenement as a result of the subdivision shown on DP 180747.
