The applicants claim the easement is redundant by reason of the circumstances set out below.

Easement: Right of way over part Lot 1 DP 165238 marked “A” on DP 167428 comprised in Computer Registers NA99D/209 and NA102B/59 appurtenant to Lot 2 DP 180747 comprised in Computer Register NA111D/529 specified in Easement Certificate C901583.4 registered on 28 September 1995.

Circumstances: The dominant tenement has become physically separated from the servient tenement as a result of the subdivision shown on DP 180747.
