The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a right of way.

The applicant claims the right of way is redundant by reason of the circumstances set out below.

I intend to remove the right of way on 23 May 2017 if no objections have been received before that date.

Applicants: David Christopher Godfrey, Pamela Joyce Godfrey, Gregory James Donald and Tina Donald, c/o Beadel Ching, Solicitors, PO Box 1535, Christchurch 8140.

Easement: Right of way over part Lot 8 DP 73565 marked “A” on DP 69996 contained in Certificate of Title CB40A/847 and part Lot 2 DP 367325 marked “G” on DP 367325 contained in Certificate of Title 273341 specified in Easement Certificate A195338.8 registered on 20 September 1995.

Circumstances: The dominant land has become physically separated from the servient land as a result of subdivision of DP 73565 and DP 367325.
