Road Realignment—Herepuru Road, Matata, Whakatane District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Janine Stocker, Land Information New Zealand:

  1. Pursuant to sections 20 and 114, declares that, an agreement to that effect having been entered into, the land described in the First Schedule to this notice is hereby acquired for road and shall vest in the Whakatane District Council saving and excepting all minerals within the meaning of the Land Act 1924;

  2. Pursuant to section 116, declares the portion of road described in the Second Schedule to this notice to be stopped and, pursuant to sections 117(3) and 120(3), amalgamated with the land in Computer Freehold Register SA71B/273, subject to all existing encumbrances;

  3. Pursuant to section 116, declares the portion of road described in the Third Schedule to this notice to be stopped and, pursuant to sections 117(3) and 120(3), amalgamated with the land in Computer Freehold Register 538908, subject to all existing encumbrances; and

  4. Pursuant to section 28, declares the land described in the Fourth Schedule to this notice to be subject to a right to transmit electricity, telecommunications and computer media in favour of Lot 2 DPS 90150 on the same terms and conditions as Easement Instrument 5782710.3

on the date of publication hereof in the New Zealand Gazette.
